SECTION 3 – DELIVERY POLICY

Unless specifically stated, delivery of the products are not included.

We will assist in obtaining quotations for product shipment from our premises to the address of the client’s choosing.

The Provider will supply all goods to the delivery company in good order and will ensure that goods arrive at the User’s chosen delivery address in the same good order.

We are not responsible if information made available on this site is not accurate, complete or current. Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any colour will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

The provision of goods and services by 3D Energy Solutions (Pty) Ltd is subject to availability. In cases of unavailability, 3D Energy Solutions (Pty) Ltd will refund the client in full within 30 days. Cancellation of orders by the client will attract a 25% administration fee. SECTION 7 – ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates so that we can complete your transactions and contact you as needed.

SECTION 8 – PAYMENT OPTIONS ACCEPTED, TRADING CURRENCY

Payment may be made via Visa, MasterCard, Diners or American Express Cards, Snapscan, PayFast or by bank transfer into the 3D Energy Solutions (Pty) Ltd bank account, the details of which will be provided on request.

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

SECTION 9 – CARD ACQUIRING AND SECURITY

Card transactions will be acquired for 3D Energy Solutions (Pty) Ltd via PAYFAST who is an approved payment gateway for all South African Acquiring Banks. PAYFAST uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website.

Customer details will be stored by 3D Energy Solutions (Pty) Ltd separately from card details which are entered by the client on PAYFAST secure site.

SECTION 10 – OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

This website is governed by the laws of South Africa and 3D Energy Solutions (Pty) Ltd chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, Stikland, Bellville, Western Cape, South Africa.

Except to the extent applicable law, if any, provides otherwise, this Agreement, any access to or use of the Website will be governed by the laws of South Africa, excluding its conflict of law provisions, and the proper venue for any disputes arising out of or relating to any of the same will be the province and courts located in Cape Town. Except for claims for injunctive or equitable relief or claims regarding intellectual property rights (which may be brought in any competent court without the posting of a bond), any dispute arising under this Agreement shall be finally settled in accordance with the Comprehensive Arbitration Rules of the Judicial Arbitration and Mediation Service, Inc. (“JAMS”) in the case of a United States-South Africa dispute; Arbitration Foundation of Southern Africa (“AFSA”) in the case of a domestic South African dispute; Arbitration Foundation of Southern Africa International (“AFSA International”) in the case of any cross-border disputes, except for China-Africa disputes; China-Africa Joint Arbitration Centre (“CAJAC”) in the case of a China-Africa disputes or equivalent by three arbitrators appointed in accordance with such Rules. The arbitration shall take place in Bellville (Cape Town) in the English language and the arbitral decision may be enforced in any court. The prevailing party in any action or proceeding to enforce this Agreement shall be entitled to costs and attorneys’ fees.

Returns Policy

SECTION 1 – GENERAL

Our policy lasts 30 days. If 30 days have gone by since your purchase, unfortunately we can’t offer you a refund or exchange.

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging. If a new item is defective in any way this must be reported to us as soon as reasonably possible. We highly recommend testing out your purchases as soon as you receive them to make sure that everything is in full working order.

If you return an item you will be offered a 3denergysolutions voucher refund or a product exchange. If you specifically require another form of refund (i.e. credit card or EFT), kindly request this and we will do our best to accommodate it.

To complete your return, we require a receipt or proof of purchase.

Please do not send your purchase back to the manufacturer.

SECTION 2 – REFUNDS

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days to be confirmed with you.

Only partial refunds are granted when any item not in its original condition; any item that is damaged or missing parts for reasons not due to our error, is being returned.

If you haven’t received a refund yet, first check your bank account again. Then contact your credit card company, it may take some time before your refund is officially posted.

Next contact your bank. There is often some processing time before a refund is posted. If you’ve done all of this and you still have not received your refund yet, please contact us at info@3denergysolutions.co.za.

SECTION 4 – SALE ITEMS

Only regular priced items may be refunded in full, unfortunately sale items cannot be refunded in full, but will be refunded at the sales price at which it was acquired.

SECTION 5 – EXCHANGES

We only replace items if they are defective or damaged.  If you need to exchange it for the same item, send us an email at info@3denergysolutions.co.za and we will send you the address for the courier.

SECTION 6 – GIFTS

If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be emailed to you.

If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to them to give to you later, we will send a refund to the gift giver and he will find out about your return.

SECTION 7 – SHIPPING

We are unable to accept any returns via the post office, but will arrange for our courier to collect these from you. 3denergysolutions will cover the costs of any courier to return products to us if the return is due to a defective or damaged product where the defect or damage occurred during packing and shipping to you. 3denergysolutions will also cover the costs to resend the product to you again.

You will be responsible for paying for your own shipping costs for returning your item in the case of exchanges of a product that is not defective or damaged. These shipping costs are non-refundable. We will provide you with the address for courier by email at info@3denergysolutions.co.za. The resending costs, in this case, will be charged to you (the customer) and will be R100. Depending on where you live, the time it may take for your exchanged product to reach you may vary.

If you are shipping an item over you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.
